Terms

These terms are the agreement between Mykyta Troiepolskyi, NIP 8993064787, Wrocław, Poland ("Kaparo", "we") and the business that installs Kaparo: Preorders & Deposits in its Shopify store ("you"). Installing or using the app means you accept them, together with the privacy policy and the data processing agreement, which is part of these terms.
1. What Kaparo does
Kaparo sets up pre-orders in your store through Shopify's own checkout: the full price at checkout, or a deposit then and the balance on a date or when the order ships. It asks Shopify to charge the balance with the payment method the customer saved at checkout, tells the customer by email, and shows you what is paid and what is owed. It adds no code to your theme.
2. Your side
- You sell to your customers, not us. The products, the prices, the ship dates you promise, refunds and the law that applies to selling goods before they are in stock are yours to get right.
- Your store has to tell customers clearly what they pay now, what is charged later and when. Kaparo shows this on the product page and at checkout; don't hide or contradict it.
- Use the app only for your own store, and don't try to break it or get around its limits.
3. Price and payment
Kaparo costs a fixed monthly or yearly price for the plan you choose, shown on its Shopify App Store page and in the app. There are no per-order fees. Each plan covers pre-orders up to a value per month, and the app tells you when you pass it; if you stay above it for 30 days, new pre-order setups wait until you change plan. Shopify bills you for Kaparo on your Shopify invoice, after any free trial shown when you pick a plan. We give at least 30 days' notice of a price change.
4. Refunds
If Kaparo isn't working out, email us and we'll refund your most recent monthly charge. No questions, no form. Refunds for a yearly plan are pro-rated to the months you haven't used. Ask within 30 days of the charge.
5. Ending it
You can stop at any time by uninstalling the app. Balances that Kaparo hasn't charged by then are not charged by Kaparo afterwards, so collect them yourself in Shopify. We may suspend or end the service for a store that breaks these terms or Shopify's, with notice where we can give it. What happens to the data is in the data processing agreement.
6. Support and availability
Support is by email at support@kaparo.app, with a reply from a person within 24 hours on weekdays. We work to keep Kaparo running and correct, but we don't promise it will never be interrupted, and it depends on Shopify, on your payment provider and on email delivery, which we don't control. A charge can fail because a card is declined or needs the customer's approval; Kaparo tells you when that happens.
7. Liability
Nothing here limits liability that the law doesn't allow to be limited, such as for intent or gross negligence. Beyond that, we are not liable for lost profit or indirect loss, and our total liability to you in any twelve months is limited to what you paid for Kaparo in those twelve months.
8. Shopify
Kaparo is our app, not Shopify's. We alone are responsible for it. Shopify is not liable for any fault in the app or for any harm that comes from installing or using it, and Shopify doesn't help with installing or using it. We are responsible for how the app accesses, stores and uses your store's data.
9. Changes and law
If we change these terms in a way that matters, we email you at least 30 days before the change takes effect; carrying on after that date means you accept it. These terms are governed by the law of Poland, and its courts decide disputes, unless the law where you are gives you rights that can't be signed away.
